Terms and Conditions
These terms and conditions ("Terms") govern your use of the Coote Road Wines website (the "Site") and your purchase of products from the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, then you may not access the Site or use any services offered through the Site.
1. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:
- In any way that violates any applicable federal, state, local, or international law or regulation;
- To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm us or users of the Site, or expose them to liability;
- To engage in any conduct that could disable, overburden, damage, or impair the Site or interfere with any other party's use of the Site.
2. Age Restriction
By using this Site, you affirm that you are at least 18 years of age or older. Coote Road Wines does not sell alcohol to persons under the age of 18. By placing an order through the Site, you confirm that you are at least 18 years old. Coote Road Wines reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at its sole discretion.
3. Liquor Control Act 1988 Compliance
Under the Liquor Control Act 1988, it is an offense:
- To sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or
- For a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises.
4. Orders and Payment
All orders placed through the Site are subject to availability and acceptance. Once you place an order, you will receive an email confirmation from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance by sending you an email that confirms that the product has been dispatched (the "Dispatch Confirmation"). The contract between us will only be formed when we send you the Dispatch Confirmation.
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
5. Limitation of Liability
In no event shall Coote Road Wines, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
6. Governing Law
These Terms shall be governed and construed in accordance with the laws of South Australia, without regard to its conflict of law provisions.
